The Sheriff Who Remembers the Republic

To understand the office of sheriff at the county level is, for most Americans, to enter a brave new world.

It is a return to a place long forgotten.

A return to something called the Republic.

A Republic in which government does not simply announce its authority and expect obedience.

A Republic in which authority must be identified, jurisdiction established, and power exercised within constitutional limits.

Standing closest to the people is the sheriff.

Not merely another law-enforcement officer.

Not another employee of the state.

But an elected constitutional officer who swears an oath to support and defend the Constitution and preserve the peace of the county.

So what would happen if a sheriff actually understood that oath?

Imagine this.

It is late afternoon in Page County, Virginia.

A convoy of black SUVs arrives at the sheriff’s office.

Twenty heavily armed agents from the Internal Revenue Service, the FBI, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Department of the Treasury step inside wearing helmets, body armor, rifles, pistols, and tactical gear.

The lead agent approaches the sheriff.

“Good afternoon, Sheriff.

My name is Mr. Pompeii.

We’re here to inform you that early tomorrow morning a federal tactical team will be raiding the home of Bernie Haymaker.

We intend to arrest Mr. Haymaker for willful failure to file federal income tax returns.

You and your deputies are invited to accompany us.”

The sheriff slowly rises from his chair.

He looks at Mr. Pompeii.

Then at the tactical team behind him.

Then he speaks.

“Mr. Pompeii, welcome to Page County.

I am the elected Sheriff of this county.

And let me make one thing perfectly clear.

There will be no raid on the Haymaker home.

There will be no forced entry.

There will be no arrest.

And there will be no cooperation from this office.”

The room becomes silent.

The sheriff continues.

“I know Bernie Haymaker.

I know his family.

I know he has spent years attempting to understand the law.

He has written members of Congress.

He has written United States Senators.

He has written the Internal Revenue Service.

He has asked one simple question.

‘What law compels me to file a federal income tax return?’

He asked for the statute.

He asked for the regulations.

He asked for the legal authority.

He asked your government to explain itself.

And no one answered him.

No Congressman.

No Senator.

No IRS official.

No government attorney.

No one.”

The sheriff steps closer.

“So let me understand this.

Your government refuses to answer a citizen’s lawful questions...

yet now arrives with twenty armed agents prepared to invade his home?

That is not constitutional government.

Not here.”

Mr. Pompeii replies,

“Sheriff, this is a federal matter.”

The sheriff nods.

“So you keep saying.

Now prove it.” And let me inform you that this is a Republic issue, an issue of constitutional constraints.

“I want your full legal identity.

Your agency.

Your chain of command.

Your warrant.

Your indictment.

The statutes you claim apply.

The regulations implementing those statutes.

The jurisdiction you claim exists.

And I want the federal government to answer every unanswered question Bernie Haymaker has already placed before it.

Until that occurs...

you will stand down.”

Mr. Pompeii responds,

“Sheriff, you don’t have authority to stop a federal investigation.”

The sheriff smiles.

“No, Mr. Pompeii.

You misunderstand me.

I am not debating whether your agency claims authority somewhere. I am telling you of my authority and the limited authority your superiors have under the US Constitution.

I am telling you that before twenty armed men move against one of the people of this county, I intend to know exactly what authority you possess and whether you have exceeded it.

Because I also possess authority.

And I have sworn an oath to protect the people of this county from errant abuse.”

The sheriff removes a thick file from his desk.

“This belongs to Bernie Haymaker.

Inside are years of letters.

Questions.

Research.

And his documented good-faith understanding of the law.

He repeatedly invited the government to explain itself.

The government remained silent.

Now you accuse him of acting willfully.

Willfulness means knowingly violating a known legal duty.

How do you intend to prove that...

when your own government refused to identify the duty he repeatedly asked about?

You do not answer a citizen’s questions with silence...

and then answer his silence with rifles.”

The sheriff pauses.

“That is not justice.

That is intimidation.”

He looks directly at the assembled agents.

“Gentlemen...

badges do not create authority.

Weapons do not create authority.

Uniforms do not create authority.

Authority must exist before the badge is pinned on.

The Constitution was written to limit government.

That is the oath I took.

Apparently it is an oath many have forgotten.”

The sheriff continues.

“Most Americans no longer understand what the constitutional office of sheriff was intended to be.

The sheriff is not simply another government employee.

He is the constitutional officer closest to the people.

His duty is not blind cooperation.

His duty is preserving the peace.

His duty is protecting the rights of the people.

And his duty is ensuring that government itself remains within constitutional boundaries.”

He points toward the tactical team.

“Page County is not occupied territory.

The Haymaker family is not an enemy force.

A disputed tax matter is not a military operation.

Twenty armed agents do not become lawful merely because they arrive prepared for war.”

The sheriff places his hand upon the Haymaker file.

“If Bernie Haymaker is prosecuted, I will testify.

I will testify that he repeatedly sought answers.

I will testify that he documented his understanding.

I will testify that he openly attempted to determine his legal obligations.

Whether a court ultimately agrees with him is not for me to decide.

But no jury should ever be denied the opportunity to hear evidence of his documented good-faith belief.”

The sheriff now stands only a few feet from Mr. Pompeii.

“So here is what is going to happen.

You will return to your superiors.

You will tell them that the Sheriff of Page County requires a complete response to Bernie Haymaker’s unanswered questions.

You will produce the authority you claim.

You will establish your jurisdiction.

You will identify the statutes and regulations upon which you rely.

And you will demonstrate that every constitutional safeguard will be honored. You will also provide me your real names, copies of your ids, insurance, bonds, oaths of office

Until then...

my deputies will not participate.

They will not assist.

They will not secure your perimeter.

They will not lend the authority of this county to an operation whose constitutional foundation remains unanswered.”

The sheriff pauses. And if you ever arrest Mr. Haymaker. It will be because I go to his house and ask him politely to come with me but only after explaining the reasons why. It will be at that point that I will hand him to you. For there will be no gamesmahsip of silly games of grown boys playing cops and robbers here. You will not terrorize this peaceful place.

“This...

is what the constitutional office of sheriff was meant to be.

Not a servant of Washington.

Not a servant of Richmond.

But a servant of the people.

A guardian of the peace.

A defender of liberty.

A constitutional barrier between government power and a free citizen.”

He looks directly at every federal agent in the room.

“The Republic does not survive because the Constitution hangs on the wall of a courthouse.

It survives because men and women have the courage to enforce its limitations.

It survives because someone is willing to ask government the one question it rarely expects to answer:

‘By what authority?’

And until that authority is established...

until Bernie Haymaker’s questions have been answered...

until the government demonstrates that it is acting within constitutional limits...

the answer is simple.

Not here.

Not today.

Not in Page County. Now leave my county and let the good people here alone.

May truth reign supreme.
